Terms & Conditions

This Affiliate Agreement (“Agreement”) is entered into by and between Queenscliff Global LLC DBA Retouching Academy (“Retouching Academy,” “we,” “us,” or “our”) and you (“Affiliate”).

By joining our Affiliate Program, you agree to the terms outlined below.

 

1. Enrollment & Eligibility

We welcome applications from individuals and businesses interested in promoting our products. However, to maintain the integrity of our brand, we carefully review all applications and reserve the right to decline or remove affiliates whose content, website, or promotional strategies do not align with our values.

 

2. Affiliate Responsibilities

To ensure a fair and ethical program, we ask that you:

• Use only the provided affiliate links for promotions.
• Avoid altering or manipulating tracking links.
• Refrain from misleading or deceptive advertising.
• Do not bid on search engine keywords or domain names containing “Retouching Academy.”
• Avoid spam, cookie stuffing, or any unethical marketing techniques.
• Do not purchase our products through your own affiliate link.

Failure to follow these guidelines may result in removal from the program and forfeiture of commissions.

 

3. Commission Structure & Payments

We value your efforts and will reward you with commissions on eligible sales. Here’s how it works:

• Commissions are based on net sales (after transaction fees and chargebacks).
• Payments are processed monthly, within the first fifteen (15) days of the second month following the sale. This is to allow the potential returns and refunds from our customers to go through the system.
• Payments are made via PayPal or Payoneer to the account registered in our Affiliate Program. Please let us know if you prefer a different payment platform, we may consider using it.

 

4. Tracking & Cookies

To ensure fair attribution, sales are tracked through cookies:

• Cookies remain active for 30 days from the first click.
• Our program follows a “last-click” model, meaning the last affiliate link clicked before the purchase receives credit.
• If a user blocks cookies, tracking may not be possible.

 

5. Termination & Modifications

We understand that business relationships evolve, so either party may terminate this agreement at any time with written notice to support (at) retouchingacademy.com. If the agreement is terminated:

• You must remove all affiliate links from your website and marketing materials.
• Any pending commissions will be processed based on our standard policies.
• We reserve the right to modify the agreement as needed, and continued participation implies acceptance of any updates.

 

6. Confidentiality

We respect your privacy and expect the same in return. Any non-public information shared with you as an affiliate must remain confidential and cannot be disclosed or used for personal gain.

 

7. Limitation of Liability

While we strive to maintain a smooth affiliate experience, we cannot be held responsible for indirect, special, or consequential damages. Our total liability shall not exceed the total commissions paid to you.

 

8. Independent Contractor Relationship

Our affiliates are independent partners, not employees or representatives of Retouching Academy. This agreement does not create any employment, agency, or joint venture relationships.

 

9. Fraud & Violations

We take program integrity seriously. Any fraudulent activity, such as fake orders or misleading promotions, will result in immediate termination and forfeiture of commissions.

 

10. Governing Law

This Agreement is governed by the laws of the State of Texas, USA. Any disputes arising under or related to this Agreement will be resolved through binding arbitration in Texas, in accordance with the rules of the American Arbitration Association, rather than in court.
